Congresso mantém veto à “desaposentação”
Em sessão na noite de terça-feira (15), o Congresso Nacional decidiu manter os cinco vetos da pauta. Os parlamentares mantiveram o veto parcial (VET 49/2015) ao Projeto de Lei de Conversão (PLV) 15/2015, decorrente da MP 676/2015, que altera a fórmula para aposentadorias em alternativa ao fator previdenciário e cria o fator conhecido como 85/95.
O Executivo alegou que os artigos vetados contrariam o interesse público, pois poderiam aumentar os custos para a Previdência. Segundo as normas previstas na Lei 13.183/2015, se quiser se livrar do fator previdenciário, a mulher deve ter, no mínimo, 30 anos de contribuição para a Previdência Social e 55 anos de idade. Já os homens devem ter contribuído por 35 anos e ter 60 anos.
Um dos vetos foi ao artigo que possibilitava a “desaposentação”. Segundo a proposta original, poderia haver um novo cálculo no valor do benefício previdenciário se a pessoa continuasse a trabalhar depois de se aposentar. O texto previa que a desaposentação aconteceria depois de o aposentado contribuir para o INSS por, pelo menos, 60 meses no novo emprego. O Executivo alega que a medida contraria os pilares do sistema previdenciário brasileiro e permitiria a acumulação de aposentadoria com outros benefícios de forma injustificada.
O item da desaposentação chegou a ser apreciado em destaque, de forma separada. O deputado Afonso Florence (PT-BA) defendeu a manutenção do veto, como uma forma de colaborar com o rigor fiscal. Já o deputado Arnaldo Faria de Sá (PTB-SP) argumentou que várias decisões foram dadas na Justiça em favor dos aposentados que retornaram ao trabalho. No STJ, o direito à desaposentadoria foi confirmado. O governo recorreu ao STF que, segundo o deputado, “esqueceu” de julgar a matéria, na pauta do tribunal há mais de um ano.
— Queremos garantir a questão da desaposentação, para que a pessoa possa, pelo menos, aumentar um pouquinho o seu rendimento — disse o deputado.
Apesar do discurso do deputado, o veto foi mantido. Outro item vetado trata das regras para o pagamento do seguro-desemprego ao trabalhador rural. O texto estabelecia, entre outros requisitos, que poderia receber esse benefício quem comprovasse ter recebido seis meses de salário antes da demissão. A presidente Dilma Rousseff argumentou que a mudança na lei traria critérios diferenciados para o trabalhador rural receber o seguro-desemprego, em prejuízo aos trabalhadores urbanos.
Tarifas e inatividade
Um outro veto mantido foi o parcial (VET 48/2015) à Medida Provisória (MP) 677/2015. O veto refere-se ao trecho que acaba com a cobrança das bandeiras tarifárias. A presidente Dilma Rousseff vetou o parágrafo que ampliava o prazo para que agentes que operavam no âmbito dos Sistemas Isolados em 31 de dezembro de 2014 migrassem para o Sistema Interligado Nacional.
O Congresso ainda decidiu manter o veto total (VET 52/2015) ao Projeto de Lei do Senado (PLS) 304/2008, que reduzia de dez para cinco anos o período sem registro na junta comercial que caracteriza a inatividade do empresário ou da sociedade empresária. Segundo o governo, “a redução do período de obrigatoriedade da declaração de atividade da empresa perante a junta comercial seria contrária aos princípios da eficiência administrativa e da economicidade, norteadores dos esforços de simplificação da relação entre entidades e órgãos públicos e o setor privado”.
Braile e direito de resposta
Também foi mantido o Veto 50/2015, que atingiu parcialmente o PLS 141/2011, que se transformou na Lei 13.188/2015. A nova norma regulamenta o direito de resposta contra conteúdo considerado ofensivo na mídia. A presidente vetou o dispositivo que previa retificação pessoalmente em rádio e TV. O PCdoB votou pela derrubada do veto.
— Consideramos que esse veto anula a essência do que conseguimos, depois de muita luta, aprovar aqui, que é o artigo que determina a possibilidade de dar o direito de resposta na mídia, inclusive, com a possibilidade da resposta pessoal — criticou a deputada Jandira Feghali (PCdoB-RJ).
Senadores e deputados ainda mantiveram o veto integral (VET 51/2015) ao PLS 67/2011, que regulamenta o exercício das profissões de transcritor e de revisor de textos em braile. O governo alegou que a proposta é inconstitucional, por limitar o exercício das profissões.
